These Terms of Use explain the rules for using Scavenger Hunt Walking Tours, including our website, our scavenger hunts, and related services.

By using our services, you agree to these terms. If you do not agree, do not use the services.

1. Who we are

Scavenger Hunt Walking Tours, LLC offers self-guided scavenger hunt experiences and related website features.

In these terms, “we,” “us,” and “our” mean Scavenger Hunt Walking Tours. “You” means the customer, participant, or visitor using the service.

2. Who can use the service

You must be old enough to enter into a binding agreement where you live, or have permission from a parent or legal guardian.

You are responsible for making sure that anyone on your team using the service does so safely and in line with these terms.

3. Your account and access

Some parts of the service require an account, a purchase, or a login through our website.

You are responsible for:

  • keeping your login information secure
  • using the service only through your own account or a team account you are allowed to use
  • making sure the information you give us is accurate

We may suspend or limit access if we believe an account is being misused, shared improperly, used fraudulently, or used in a way that harms the service or other users.

4. What you are buying

When you purchase a scavenger hunt, you are buying a limited right to access and use that hunt through our service for personal or internal team use, subject to these terms.

Your purchase does not give you ownership of the software, content, hunt materials, maps, questions, branding, or other materials in the service.

5. Location-based features

Our scavenger hunts work better when location access is turned on. If you allow location access, we may use your device’s location to:

  • show your position on the map
  • help show distances or directions during gameplay
  • improve gameplay flow and check-in features

Location access is optional. You can still use the service without sharing location, but some map and distance-based features may be limited or less helpful.

You are responsible for deciding whether to enable location services on your device.

6. Safety and real-world use

This is a real-world walking activity. You agree to use common sense and stay aware of your surroundings at all times.

You must not use the service in a way that is unsafe or illegal, including while:

  • driving
  • entering restricted or private property without permission
  • ignoring traffic laws, posted warnings, or venue rules
  • putting yourself or others at risk

You are responsible for your own safety and the safety of your group. We are not responsible for injuries, property damage, trespassing, theft, weather issues, street closures, business closures, construction, crowd conditions, or other real-world conditions that may affect gameplay.

7. User photos and other content

Some hunts or challenges may let you upload photos or other content.

You keep ownership of content you upload, but you give us a limited license to host, store, process, transmit, display, and make copies of that content as needed to:

  • run the service
  • provide photo-library and progress features
  • support your account
  • maintain, secure, debug, and improve the service
  • enforce these terms

This license is non-exclusive, worldwide, royalty-free, and lasts only as long as reasonably needed for those purposes, subject to our records retention and legal obligations.

8. What you promise about uploaded content

If you upload content, you promise that:

  • you have the right to upload it
  • it does not violate anyone else’s rights, including privacy, publicity, or copyright rights
  • it is not illegal, abusive, threatening, defamatory, hateful, obscene, or sexually explicit
  • it does not contain malware, harmful code, or anything meant to disrupt the service

We may remove content or restrict access if we believe it violates these terms, creates risk, or exposes us or others to liability.

9. Public use of participant photos

We do not publicly post participant-uploaded challenge photos to our website by default.

Your upload gives us the operational rights described above, but it does not by itself give us the right to use your photos in public marketing, social media, ads, or website galleries.

If we later want to offer a feature that allows public or promotional use of participant photos, we may ask for separate express permission.

10. Acceptable use

You agree not to:

  • copy, scrape, reverse engineer, or interfere with the service except as allowed by law
  • bypass access controls, enrollment checks, or purchase requirements
  • use bots or automation to access the service in a harmful way
  • upload unlawful or infringing content
  • try to disrupt the website, service, hosting, storage, or connected systems
  • use the service to harass, stalk, or invade someone else’s privacy

11. Changes to hunts and service availability

We may update hunts, questions, stops, routes, software, and features at any time.

We do not guarantee that every hunt, stop, question, venue, business, map point, or route detail will always be available, accurate, open, or unchanged. Real-world environments change, and some parts of a hunt may need to be updated, replaced, or removed.

We may also suspend or discontinue any part of the service.

12. Intellectual property

The service, including its software, design, gameplay systems, text, graphics, branding, hunt content, maps, media, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

Except for the limited use rights described in these terms, you do not receive any ownership or license rights in our intellectual property.

13. Third-party services

Parts of the service may rely on third-party platforms or tools, such as website hosting providers, ecommerce or booking systems, payment processors, cloud service providers, mapping tools, analytics tools, browsers, mobile operating systems, and social sharing tools.

We are not responsible for third-party services or outages, policy changes, security issues, or feature changes on those platforms.

14. Purchases, refunds, and chargebacks

Purchases may be subject to separate checkout, booking, refund, or cancellation terms shown at the time of sale.

If you believe you were charged incorrectly, contact us first so we can try to resolve it. Fraudulent chargebacks, abuse of refund systems, or other payment misuse may result in account restrictions or collection efforts where allowed by law.

15. Disclaimers

The service is provided “as is” and “as available.”

To the fullest extent allowed by law, we do not promise that the service will always be uninterrupted, error-free, secure, or perfectly accurate, or that every feature will work on every device, browser, or location.

We also do not promise that gameplay, route advice, map displays, venue information, or challenge content will always match real-world conditions.

16. Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or use.

To the fullest extent allowed by law, our total liability for any claim related to the service will not exceed the amount you paid us for the specific scavenger hunt or service giving rise to the claim during the 12 months before the claim arose.

Some places do not allow certain liability limits, so some of these limits may not apply to you.

17. Your responsibility to us

If your actions, uploaded content, misuse of the service, or violation of these terms causes claims, losses, liabilities, costs, or expenses for us, you agree to reimburse and defend us to the extent allowed by law.

18. Ending access

You may stop using the service at any time.

We may suspend, limit, or terminate access if:

  • you violate these terms
  • we believe your use creates legal, security, or operational risk
  • we are required to do so by law
  • we stop offering the relevant service

Sections that are meant to survive termination will continue to apply, including sections on content rights, disclaimers, liability limits, disputes, and intellectual property.

19. Changes to these terms

We may update these terms from time to time. When we do, we will post the updated version and change the “Last updated” date.

If you keep using the service after the updated terms take effect, that means you accept the updated terms.

20. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except to the extent that applicable consumer protection laws require otherwise.

Any dispute arising out of or relating to these terms or the service must be brought exclusively in the state or federal courts located in California, and you consent to those courts’ personal jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
